Rule 63 of the National Company Law Appellate Tribunal Rules, 2016, dealing with the appearance of authorized representatives, has now been amended by the National Company Law Appellate Tribunal (Amendment) Rules, 2017. As per this amendment, the following rule has been substituted in place of rule 63:
A party to any proceedings or appeal before the Appellate Tribunal may appear in person or authorize one or more chartered accountants, company secretaries, cost accountants, legal practitioners, or any other person to present his case before the Appellate Tribunal, subject to the provisions of section 432 of the Companies Act, 2013.
In proceedings before the Appellate Tribunal, the Central Government, the Regional Director, the Registrar of Companies, or the Official Liquidator may appoint an official or an Advocate to represent them.
The officer appointed by the Central Government, the Regional Director, the Registrar of Companies, or the Official Liquidator must not hold a rank lower than that of a Junior Time Scale or a company prosecutor.
