About the Indian Trademark Registry

The Indian Trademark Registry, operated by the Office of the Controller General of Patents, Designs and Trade Marks (CGPDTM) under the Department for Promotion of Industry and Internal Trade (DPIIT), maintains the public record of every trademark ever filed in India. Filings are governed by the Trade Marks Act, 1999 and the Trade Marks Rules, 2017, and are processed through five regional offices: Mumbai, Delhi, Kolkata, Chennai and Ahmedabad. What is a Trademark Search?

A trademark search checks whether a brand name, logo, slogan, or device mark is already registered or pending on the IP India Controller General of Patents, Designs and Trade Marks (CGPDTM) register. Searching the official register helps you check whether your proposed mark is available and identify similar existing marks before filing. It then flags the identical or similar marks that may face objections under Sections 9 and 11 of the Trade Marks Act, 1999. It also helps you choose the correct Nice Classification class.

  • ™ (Trademark): Used for a mark you're claiming as your brand, registered or not. No registration is needed to use it.
  • ® (Registered): Used only for a trademark registered with the Trade Marks Registry. Using the symbol for an unregistered trademark is prohibited under Section 107 of the Trade Marks Act, 1999.
  • SM (Service Mark): Occasionally used to indicate a mark for services rather than goods. It has no formal legal status under Indian law.
