Important Guidelines to know while choosing your Company Name

The following are some of the vital guidelines to know while choosing your Company Name:

  1. Similar or Identical Name: The Company Name cannot be similar to an existing or already registered Company, LLP, or Trademark. Joining/separating words, different tenses, spacing, plural versions, the addition of the place, titles, and other small differences wouldn't make the Company Name unique & different.

  2. Government Relevance: The name cannot have words such as Hindustan, Central, National, Government, Union, or Ministry in it unless prior approval from the Government is obtained.

  3. Trademark: The Name of the Company cannot infringe on a registered Trademark or an application for Trademark Registration.

  4. Financial Terms: The name of the Company shouldn’t include any financial terms like insurance, bank, stock exchange, venture capital, asset management, mutual funds, or other financial activities unless a declaration is received from IRDAI, RBI, SEBI, etc.

  5. Constitution: There cannot be words that signify a business-type constitution or legal individual or any connotation. For example, words like Trust, Proprietor, HUF, Co-Operative, Sehkari, etc., cannot be a part of a Company Name.

  6. Check for Plurals: If the Company name chosen is merely the plural version of an existing Company name, then the name is not considered unique or distinct. For example, if the Company name is Rixon Game Private Limited, then the name Rixon Games Private Limited is not unique & will stand rejected.

  7. Spaces between letter case, words, punctuations, etc., Making changes to the letter cases or the spacing between the words or to the punctuation marks in an already existing name doesn’t render the name unique. If the Company’s name is Rixon Game Private Limited, then the name Rixon Game Pvt Ltd or RIXON GAME Private Limited is not unique & cannot be registered.

  8. Disjoining or Combining the words: Arriving at a Company Name by detaching or joining the words of an existing Company Name will not be considered a new or unique name. If the Company’s Name is Rixon Game Private Limited then the name RiXon Game Private Limited or RixonGame Private Limited will not be approved.

  9. Reversing the Combination of Words: Reversing or rearranging the order of words in an existing title cannot be considered as uniqueness. For example, if the name is AB and XY Private Limited changing it to XY and AB Private Limited is not considered to be unique.

  2. The Company name contains commas or full stops;
