Indian Legal Metrology Act, 2009: It is the legal law that governs weights and measures standardization of India. It distinctly states that each measuring instrument, including an infrared thermometer shall receive model approval and be registered by LMD.

Main Requirements:

Model Approval: The models of infrared thermometers shall be approved by the LMD prior to these devices being manufactured/imported. Manufacturers/importers must apply to LMD with specimen model for testing/verification.

•Registration of Manufacturer/Packer : Infrared thermometer manufacturers and packers shall get registered with the LMD.

Verification and Stamping: All the infrared thermometers shall be verified and stamped by the LMD after ascertaining it as highly accurate and in line with legal metrology specifications.

• Packing and labelling: Their infrared thermometers must also be packed and labelled according to some specification which should have some indication of instructions for use and accuracy information under the Drugs and Cosmetics Act, 1940

Though infrared thermometers, per se, are not medical devices, still there are applications found in health sectors. These prerequisites from this perspective include Drugs and Cosmetics Act, 1940. This act regulates the manufacture, sale, or importation of drugs and cosmetics. Important Requirements:

• Medical Device: Considering the type, usage, and technical features of infrared thermometer it would fall into the category of medical device also. Central Drugs Standard Control Organization provides permit and license for medical devices.

• Quality Standards: Importing and manufacturing companies should adhere to GMP and other quality standards, so that the devices are safe and effective.

Import-Export Code (IEC)

If an entity imports and exports infrared thermometers they are supposed to have an Import-Export Code, IEC. This will be issued by the Directorate General of Foreign Trade, DGFT. Thus, they are facilitated to trade on the entire international platform .

Other Requirements

Duties and Taxes on Importation: Duties and taxes would be imposed on the importation of infrared thermometers.

• Specific State Laws and Regulations: There may be specific state laws or licensing requirements for specific states, regulating the sale and distribution of infrared thermometers.

• Intellectual Property Rights: Manufacturers as well as importers must also protect their intellectual property rights pertaining to infrared thermometer technology, including patents and trademarks.
