The Real Estate (Regulation and Development) Act 2016 was the product of an Indian Parliament enactment earlier this year, in May, which provided for a framework to bring into place real-estate regulatory authorities at national and state levels, thus giving homebuyers protection and sector transparency. UP RERA also set up an office in Uttar Pradesh, which handled complaints from consumers against builders, promoters, and real estate agents so as to make sure that business is done fairly.

Filing a RERA Complaint in Uttar Pradesh

The UP RERA asserts that it is uncomplicated and there are choices regarding filing a grievance, either online, offline, or via the helpline.

How to lodge an RERA official complaint online?

  1. UP RERA Website: First, you have to log in or visit the official UP RERA website. It gives information about minute processes and also issues links to the portal for registering complaints.
  2. Registration or Login: If you are a first-time user, you need to register on the website using your email ID or phone number. Current users may log in directly to their accounts.
  3. Click on the Complaints Section: Upon successful login into the portal, he or she can then access the ‘Complaint’ section, which usually resides in the topmost menu of the website.
  4. Register Complaint: Select ‘Register Complaint and provide the relevant details. This would be the description of the complaint, the type of complaint, such as delay in possession or faulty construction, the name of the builder or developer, and other such information.
  5. Fill in Personal and Transaction Information: You are required to provide registration details with personal information; this also includes your address. The next thing that you should fill in is transaction information. This may include payment receipts, agreements, and any other documents available relating to the said property.
  6. Registration Fee Payable: This will complete the registration process. ₹1,000 is the registration fee, which further needs to be paid. For paying the fee, online methods of payment through debit/credit cards or net banking can be used.
  7. Get Your Complaint Number: Once you file your complaint form and pay a small amount as a fee, then only you will get a complaint number.

Tracking Your Complaint

Having a complaint filed is great, but you also need to track it. How exactly can you do that? Let us look at various options available.

  • Track Online: You can keep information regarding your complaint lodged on the UP RERA portal by logging into your account under the head ‘Complaints’
  • Track it Offline: If one is willing, one can also visit the UP RERA office in Lucknow and Gautam Buddha Nagar (Noida) personally and ask for information.
  • UP RERA Helpline: Updates can also be obtained by calling the UP RERA helplines.

Seeking Compensation Through Uttar Pradesh RERA

If you are claiming compensation for damages/losses on account of negligence or failure to comply with the terms of the contract by the builder, you can raise a complaint for compensation separately on the UP RERA portal.

  1. Select ‘Complaint for Compensation’: On the complaint registration page, select ‘Complaint for Compensation’.
  2. Provide Essential Particulars: Under your compensation application, you must provide the necessary particulars, including the compensation amount that you are demanding, and other documents as needed.
  3. Compensation Fee Payment: As with any complaint, filing a compensation claim incurs a processing fee of ₹1,000.

Following your complaint submission, you can track the running process as explained earlier.

The Role of Uttar Pradesh RERA in Dispute Resolution

UP RERA can create a fair and transparent environment for buyers and developers in the state. It ensures the builders are working in accordance with the norms of the RERA Act, which includes the registration of projects, correct project timelines, and all permissions and approvals necessary before construction work is undertaken.

UP RERA has a forum for dispute settlement in case of any disputes. The authority will hold hearings and allow the party filing the complaint, the homebuyer, along with the respondent-builder or developer, an opportunity to present their cases. In most such cases, it is resolved after a few hearings with a final order.

Conclusion

The RERA is enshrined to govern the rights of a homebuyer and maintain clarity in transactions concerned with real estate. The UP RERA finds vital importance in protective services to consumers by meeting the standard norms under the Act, wherein builders are on the hook. Even the complaint can be filed through the UP RERA website, and with ease, one can track its status and seek redress if there is any issue faced by a buyer in a real estate project in Uttar Pradesh. Be it a delay in possession or non-compliance with project specifications, buyers can voice their issues and have them addressed in time through RERA.
